Please familiarize yourself with the agreement and terms and conditions before ordering in our online store.

This purchase is governed by standard terms and conditions of sale for consumer purchases of goods over the Internet.

The contract has been prepared and recommended for use by the Norwegian Consumer Council . Internet purchases are mainly regulated by the Contracts Act, the Consumer Purchases Act, the Marketing Act, the Enterprises Act and the E-Commerce Act, and these laws give consumers fundamental rights. The terms of the contract shall not be interpreted as a limitation of statutory rights, but constitute the main rights and obligations of the parties to the transaction. Wabi Sabi may choose to offer the buyer better terms than stated in these terms of sale.

In cases where the contract does not directly provide the solution to a problem, the contract must be supplemented with relevant legal provisions.

Agreement

The agreement between the buyer and Wabi Sabi consists of the information Wabi Sabi provides about the purchase in the order solution in the online store (including information about the type, quantity, quality, other characteristics, price and delivery terms), any direct correspondence between the parties (e.g. e-mail) as well as these Terms of Sale. In the event of a conflict between the information Wabi Sabi has provided about the purchase in the order solution in the online store and the correspondence between the parties and the Terms of Sale, the direct correspondence between the parties and the information provided in the order solution takes precedence over the Terms of Sale, unless it is contrary to mandatory law.

The buyer is the person who places the order.

Customer account

All orders placed on Wabi Sabi's online store are processed and stored in our customer system. The following information about you is stored: Name, delivery address, billing address and order history. You can choose whether to create a user profile in our online store, which gives you access to order history and makes it easier for future orders. If you choose to create an account, you must ensure your security through a secure password. If for any reason you have reason to believe that outsiders have access to your account, you should contact us immediately. If you want to delete your user profile, you can contact us by email: post@wabisabi.no.

Prices

The prices stated in the online store include VAT.

Information about the total costs that the buyer must pay includes all taxes (VAT, customs, etc.) and delivery costs (freight, postage, invoice fees, packaging, etc.). Specification of the individual elements of the total price is provided in the ordering solution before ordering (Deliveries of goods to Svalbard or Jan Mayen shall be sold without the addition of VAT).

For packages not collected where Wabi Sabi charges apply, all additional costs will be charged to the customer. This includes shipping costs, VAT and duties and other costs associated with this.

Order confirmation

An order in our online store is placed after the items in the shopping cart have been placed in the order, payment information has been added, delivery terms have been confirmed and the order has been accepted (check out). The order is not completed until you have received an order confirmation from Wabi Sabi.

Once Wabi Sabi has received the buyer's order, Wabi Sabi shall confirm the order without undue delay by sending an order confirmation to the buyer. If you have not received an order confirmation email from us within 24 hours, please contact us at: post@wabisabi.no.

We recommend that the buyer check that the order confirmation matches the order with regard to quantity, type of product, price, etc. If there is a discrepancy between the order and the order confirmation, the buyer should contact Wabi Sabi as soon as possible.

The agreement

The agreement is binding on both parties when the buyer's order is received by Wabi Sabi.

However, one party is not bound by the agreement if there is a typographical error or typographical error in the seller's offer in the ordering section of the online store or in the buyer's order, and the other party realized or should have realized that there was such an error.

Payment

Wabi Sabi may require payment for the item when it is shipped from Wabi Sabi to the buyer.

We accept Vipps, Klarna, Mastercard, Visa, Stripes and PayPal.

Buyers under the age of 18 can only pay directly upon delivery of the goods or upon delivery of the goods via mail order.

Delivery / Shipping

Delivery of the goods from Wabi Sabi to the buyer takes place in the manner, at the place and at the time specified in the order section of the online store.

Wabi Sabi's jewelry is handmade and manufactured in Tromsø. Items in stock have a delivery time of 2 – 5 working days. Items we have to produce have a delivery time of 2 – 8 working days.

Items in Norway are shipped with Bring. You will receive delivery details via email, including a tracking number that allows you to follow the item's movements during transport. Our jewelry is shipped from Tromsø.

Jewelry treatment

Wabi Sabi works with 925 sterling silver, 585 gold (14 carat), 750 gold (18 carat), gemstones and diamonds.

In the philosophy behind “Wabi Sabi” there is a beautiful Japanese saying that beauty lies in a life lived. Throughout life you will experience things. Good experiences and some difficult ones. They leave traces. We are not looking to create a shiny image of a piece of jewelry. We seek to find beauty in the small details that give the jewelry its own expression.

We create jewelry meant for everyday wear, so wear it with pride. Marks will appear as a result of the jewelry being worn – let them become part of your story.

Surface:

If you have chosen a brushed finish, it will be polished with use. This is especially true for rings that have more wear and tear than other pieces of jewelry. If your rings look too polished, most jewelers will be able to brush the surface to recreate the finish the jewelry originally had.

Silver:

Silver oxidizes and needs to be polished. This process can be delayed by proper storage. An airtight plastic bag is recommended for silver jewelry when not in use.

White gold:

We work with 585 gold (14 karat). All our jewelry can be made of 750 gold (18 karat) upon request.

The white alloy gets its bright color from the metal palladium (instead of copper used in yellow gold). Often our customers want to have their white gold jewelry rhodium plated to get the white surface that white gold is known for.

Over time, Rhodium plating will wear off. Most jewelers will be able to re-Rhodium your jewelry.

Rings are more susceptible to wear and tear than other jewelry.

Stones:

We use precious and semi-precious stones in our jewelry. Both semi-precious and precious stones are minerals that are found in nature. The difference between a precious stone and a semi-precious stone is in hardness and transparency.

Certificate and ethical guidelines

All our diamonds are imported to Norway with a Kimberley certificate. These certificates document that the diamonds have been mined under ethical conditions. They also ensure that the diamonds were not used for money laundering or to finance conflicts or warfare.

Risk for the product

The risk of the goods passes to you as the buyer when the goods have been taken over by you in accordance with the agreement. If the delivery time has arrived and you are unable to take over an item that is at your disposal under the agreement, you still bear the risk of loss or damage to the goods. Uncollected goods will be returned after 14 days, at your expense.

Returns and refunds

If you would like to exchange your jewelry for another piece/size, please send us an email: post@wabisabi.no and follow the instructions you receive via email from us. You will receive information about the procedure for returning the item to us.

Return of goods

If you wish to exercise your right of withdrawal, please give us written feedback by e-mail: post@wabisabi.no, within 14 days after you received the item. Please return the item immediately after you have received a return confirmation from us, and no later than 14 days after return confirmation. Please include your order number in all communication with us. When returning goods, the full purchase price will be returned to you within 14 days after Wabi Sabi has received the item. Shipping costs for returns on goods with a value of over NOK 1,500 are covered by Wabi Sabi.

You have the opportunity to inspect the product before deciding to withdraw from a purchase. However, the item must be returned to Wabi Sabi in the same condition and quantity as it was when you received it. The item will be returned to Wabi Sabi in the original packaging / jewelry box.

Please send us the tracking number so we can track the package. You as the buyer are responsible for the items until we receive them. We will contact you as soon as we have received the item to arrange a refund.

We cannot return “custom-made” jewelry.

Electronic gift card

Wabi Sabi electronic gift cards are available in any amount at wabisabi.no, and expire after one year. Our gift cards will not be replaced in the event of loss. Gift cards cannot be exchanged for cash. Electronic gift cards are non-refundable.

Warranty

The warranty provided by Wabi Sabi gives you rights in addition to the rights you already have under mandatory law. A warranty therefore does not limit your right to complain and claim in the event of delay or defects.

Examination of the item

When you receive the item, we recommend that you check whether the item is in accordance with the order, whether it was damaged during shipping or whether it otherwise has any defects. If the item does not correspond to the order or has defects, you must immediately notify Wabi Sabi via email: post@wabisabi.no.

Complaint

If there is a defect in the item, you must notify Wabi Sabi within a reasonable time after discovering it. The complaint period for Wabi Sabi jewelry is two years.

Conflict

The parties shall attempt to resolve any disputes amicably. You may contact the Consumer Council for assistance in any dispute with Wabi Sabi. If an amicable settlement is not reached after mediation at the Consumer Council, the parties may request that the dispute be handled by the Consumer Disputes Committee.

Decisions by the Consumer Disputes Committee shall be legally binding four weeks after notification. Before the decision becomes legally binding, the parties may, by submitting a petition to the Consumer Disputes Committee, bring the decision before the district court.

See Act of 28 April 1978 No. 18 on the handling of consumer disputes (Norwegian law).

Purchases of goods from Wabi Sabi are in accordance with Norwegian law, and any disputes must therefore be brought before the Norwegian courts.

Personal information

Unless you consent otherwise, Wabi Sabi may only collect and store the personal information necessary for Wabi Sabi to fulfill its obligations under this Agreement. The personal information of a buyer under the age of 15 cannot be obtained unless Wabi Sabi has the consent of an adult or guardian.

Your personal information will only be disclosed to others if it is necessary for Wabi Sabi to perform the agreement with you, or in statutory cases. Wabi Sabi can only obtain social security numbers if there is a significant need for secure identification and such collection is necessary.

If Wabi Sabi wants to use your personal information for other purposes, for example to send you advertising or information beyond what is necessary to perform the agreement, Wabi Sabi must obtain your consent at the time of entering into the agreement. Wabi Sabi must provide you with information about what personal information is used for and who will use the personal information. Your consent must be voluntary and given by active action, for example by checking.

You should be able to easily contact Wabi Sabi, for example by telephone or email, if you have questions about Wabi Sabi's use of personal information or if you want Wabi Sabi to delete or change your personal information.

Buyer's rights in the event of delay

If Wabi Sabi does not deliver the goods or does not deliver them according to the agreement and this is not due to you as the buyer or conditions on your part, you can withhold the purchase price, demand fulfillment, cancel the agreement and claim compensation from Wabi Sabi.

Fulfillment of agreement:

If Wabi Sabi does not deliver the goods at the time of delivery, you may maintain the purchase and set a reasonable additional deadline for performance from Wabi Sabi. However, you may not demand performance if there is an obstacle that Wabi Sabi cannot overcome or if performance would cause such a great inconvenience or cost to Wabi Sabi that it is significantly disproportionate to your interest in Wabi Sabi's performance. If the difficulties disappear within a reasonable time, you may demand performance.

Exception:

As a buyer, you may terminate the agreement with Wabi Sabi if the delay is significant, or if Wabi Sabi does not deliver the goods within the additional deadline you have set. However, you may not terminate the agreement while the additional deadline is running, unless Wabi Sabi has stated that they will not fulfill within the deadline.

Compensation:

As a buyer, you may claim compensation for losses you suffer as a result of delay on Wabi Sabi's part. In such a case, you must report the claim to Wabi Sabi.

Buyer's rights in the event of a defect

If the item has a defect and this is not due to you as the buyer or circumstances on your part, you can withhold the purchase price and choose between having the item repaired, demanding a price reduction or demanding that the purchase be cancelled.

Repair or replacement:

If the item has a defect, you may require Wabi Sabi to rectify the defect or deliver the corresponding item. Wabi Sabi may object to your claim if the implementation of the claim is impossible or imposes unreasonable costs on Wabi Sabi. Wabi Sabi shall carry out the repair or replacement within a reasonable time. The repair or replacement must be done free of charge for you as the buyer, without the risk that you will not be able to cover their costs and without significant inconvenience to you. Wabi Sabi may not make more than two attempts at repair or replacement for the same defect, unless there are special reasons that make further attempts reasonable.

Even if you do not require a repair or reassignment, Wabi Sabi may offer a repair or re-delivery if this is done without delay. If Wabi Sabi provides such repair or delivery, you may not claim a discount or cancel the purchase.

Price reduction:

If the defect is not remedied or delivered, you may demand a proportionate price reduction.

Price reduction:

Instead of a price reduction, you can terminate the agreement, except when the defect is insignificant.

Compensation:

As a buyer, you can also claim compensation for financial loss you suffer as a result of the item being defective. In that case, you must report the claim to Wabi Sabi in the event of a complaint.

The rules for complaints apply in addition to, and regardless of, the rules on cancellation rights and any guarantees given by Wabi Sabi.

Seller's rights in the event of buyer's default

If you as the buyer do not pay or fulfill your obligations under the agreement and this is not due to Wabi Sabi or circumstances on Wabi Sabi's part, Wabi Sabi may withhold the goods, demand fulfillment of the agreement, demand termination of the agreement and demand compensation from you.

Wabi Sabi may also, depending on the circumstances, be able to charge interest on late payment, collection fees and fees for unpaid items.

Fulfillment:

If you do not pay, Wabi Sabi may uphold the purchase and demand that you pay the purchase price (fulfillment). If the item is not delivered, Wabi Sabi loses its right if we wait an unreasonable amount of time to make the claim.

Exception:

In the event of a material default of payment or other material breach by you, Wabi Sabi may terminate the agreement. However, Wabi Sabi may not withdraw after the purchase price has been paid. Wabi Sabi may also cancel the purchase if you do not pay within a reasonable additional performance period set by Wabi Sabi. However, Wabi Sabi may not withdraw while the additional period is running, unless you have said that you do not want to pay.

Compensation:

Wabi Sabi may claim compensation from you as the buyer for financial loss they suffer as a result of your breach of contract.

Interest on late payment / collection fee

If you do not pay the purchase price in accordance with the agreement, Wabi Sabi may charge interest. In the event of non-payment, the claim may be sent to debt collection after prior notice, and you may then be held liable for fees.

If the buyer fails to collect unpaid goods, Wabi Sabi may charge you a fee of NOK 50, – + return shipping. The fee will cover at most Wabi Sabi's actual expenses to deliver the goods to you. Such a fee cannot be charged to buyers under the age of 18.
